It’s a tough call… but it doesn’t have to be.

For example, a ham bone for a dog is taxable, while a ham bone for soup is not. At a restaurant, mandatory gratuities for large parties are subject to sales tax, but tips given voluntarily are not. A hot coffee to go is not taxable, neither is a cold muffin to go. But if you sell them together for one price, the sale is taxable.

So it should come as no surprise that the state’s controversial new law requiring large out-of-state retailers to collect tax on sales to Californians is convoluted and already being met with resistance.

The so-called Amazon tax was included in budget trailer bill ABx1 28 and took effect June 28. The Board of Equalization has posted guidance on its website that is next to unfathomable, even for sales tax experts. You can read it at sfg.ly/mh6SxF.

In a nutshell, the law attempts to increase tax collections and level the playing field between online and traditional stores by expanding the concept of nexus.

In California, the retail sale of tangible personal property is generally subject to sales tax, unless it is an exempt item. If a retailer has a nexus or connection with the state, it is required to pay the sales tax. It may collect the sales tax from the customer but even if it doesn’t, it is still responsible for paying it.

If a retailer does not have a nexus in the state, it is not responsible for the sales tax. The buyer is supposed to pay it, in which case it is called a use tax. When individuals file their tax return, they are supposed to pay use tax on anything they bought from any out-of-state retailer that did not collect sales tax. Not many people do and it’s nearly impossible to enforce.

So California, like several other states, is trying to expand the definition of nexus. The U.S. Supreme Court says nexus requires a substantial physical presence in a state, but that’s not easy to define and is often challenged in court.

One state appeals court decision held that an out-of-state retailer that lets customers return products purchased online to an affiliated brick-and-mortar store in California has nexus in the state, says attorney Charles Moll, a partner with Winston Strawn.

Companies such as Amazon.com and Overstock.com don’t collect sales tax on purchases sent to California because they say they have no physical presence here, although they do collect it on sales to states where they do have a headquarters or certain other operations.

Hits 2 types of retailers

The new California law expands the concept of nexus to include two types of out-of-state retailers:

— One is retailers that have a subsidiary or sister company that performs services in California in connection with products sold by the retailer, “including but not limited to, design and development of tangible personal property sold by the retailer, or the solicitation of sales of tangible personal property on behalf of the retailer,” according to the BOE.

This would include, for example, a retailer that has some ownership in common with a company in California that designs its website or builds its products, but it would not include a retailer that hires an unrelated company in California to do these jobs.

Amazon has several subsidiaries in California including one that designed the Kindle. Theoretically the ownership of this company would require Amazon to collect sales tax on all sales to California. Amazon does not appear to be collecting sales tax on California purchases. It did not return repeated requests for comment.

— It also includes any retailer that has an agreement with a person in California who refers purchasers to the retailer – through a link on a blog or website, for example – and receives a commission or other fee. These are sometimes called affiliate relationships (Amazon calls them associates).

Understand what adventure travel is

Adventure travel is an active, unique exploration of an exotic or remote destination with a small group of like-minded people guided by full-time professional leaders. You could be travelling by foot, jeep or dugout canoes and it will feel like an achievement when you reach your destination.

Exceptional physical fitness isn’t necessary; you can enjoy some adventure trips at fitness level only a notch or two above that of a couch potato. But be sure to tell your guide of any physical limitations you have and/or medications you are using.

Choose your destination

The vast number of adventure trips available can be a bit bewildering. Decide early on what part of the world your want to visit, and, if you’re new to adventure travel, pick a trip that has a track record of broad appeal over the years. Also choose your variety; some people prefer to stay in one area so they can get to know it intimately, while others like to sample a wide variety of places and activities.

Dress code

Adventure travellers should dress comfortably, in layers so that you can adjust to changing conditions. Neutral colours are best if you want to see wildlife, so stay away from white and very dark colours. If you are wildlife spotting it also pays to avoid heavily perfumed lotions and potions, as most animals have extremely good noses.

Get your shoes in shape (and yourself)

While physical requirements vary greatly according to the trip, you should exercise at least 20 minutes, three times per week for two months prior to departure. And definitely break your new hiking shoes in before departing. A new pair can be the beginning and end of a trip.

What to pack

Instead of a suitcase, carry a soft, durable, waterproof duffel bag or back pack. Your bag could be in for some rough treatment (strapped to a yak, tossed on the roof of a jeep, squashed by tie-down ropes or pelted with spray in the bottom on a dugout canoe). Remember to pack a light, waterproof jacket, a bottle of water and some snacks for energy.

Hiking

Always hike at your own pace. When hiking uphill shorten your step, with heels down, rolling forward to the toe. On the downhill keep your knees slights bent and walk softly.

Respect local customs

You don’t need to learn every ritual, but a basic knowledge and respect for the most important religious customs will assure that you don’t unwittingly offend your hosts. Don’t take pictures of the locals without their permission (they may be shy or have real fears about being photographed). Plan to dress conservatively; traditional societies often have old-fashioned standards of dress, especially for women.

Keep a journal

Because adventure travel removes you so completely from normal everyday life, it invariably stimulates contemplation and triggers unaccustomed musings… write these thoughts down. You won’t regret it.

Anyone can enjoy an adventure, just be sure to bring along a spirit of adventure, a sense of humour, a flexible attitude and a healthy appreciation of sweat and dirt.

Microsoft announced just over a week ago all inbound data transfers for both peak and off-peak times being will be free with Windows Azure starting July 1.

Amazon also announced today a price cut for out-bound data transfer, as well as cuts in its CloudFront Content Delivery (CDN) pricing.

On the Amazon Web Services blog, Amazon officials discussed the potential impact of the soon-to-be-available in-bound transfer terms.

“There is no charge for inbound data transfer across all services in the US and Europe. That means, you can upload petabytes of data without having to pay for inbound data transfer fees. On outbound transfer, you will save up to 68% depending on volume usage.  For example, if you were transferring 10 TB in and 10 TB out a month, you will save 52% with the new pricing. If you were transferring 500 TB in and 500 TB out a month, you will save 68% on transfer with the new pricing.”
